LOOKING AT THE INSTITUTIONAL RESPONSE TO MY EEOC CHARGE

With the Lens of Documents Obtained through FOIA

Peter T. Kjome, former President and CEO of the Baltimore Symphony Orchestra, issued this email the same minute my EEOC charge became public.

This affidavit submitted to my EEOC charge is from the woman mentioned at the beginning of the clip. Like all other documents shared here, it was obtained through Freedom of Information Act and the redactions are my own:

In this interview with Jayne Miller of WBALTV 11 in September, 2018, Peter T. Kjome said, “However, we want to make sure that we are responding in a way that protects the employees involved and also is helping to ensure all of our employees that we have a supportive and respectful environment in which to work.”

It is difficult to reconcile his statement with #7 on the sworn affidavit.

Miller references the records which were “lost” in my initial complaint. Those are covered more fully here. The external investigator hired by the BSO in 2018, Melissa McGuire, had the following to say in her report:

Conveniently for the BSO and Jonathan Carney, this never made the news. McGuire on the lost records:

And my EEOC charge on the lost records:

Regarding substitute hiring, Melissa McGuire in her external investigation made the following recommendations despite not being able to access the substitute hiring lists:

Regarding the BSO having “updated its sexual harassment policies,” this actually means it got a sexual harassment policy for musicians for the first time ever in May, 2018, only four months before this video was filmed.

From the McGuire Report:
